Please read these Terms of Use carefully before purchasing or accessing any Smart Ops Toolkit product. By completing a purchase or accessing the Smart Ops Command Center, you agree to be bound by these terms. If you do not agree, do not access or use the product. Questions? Section 01
Product Scope — What You Are Purchasing

Smart Ops Toolkit offers digital implementation products designed to help nonprofit organizations transition to Google Workspace and reduce operational overhead. The current product offering includes:

Pillar 1: Unified Communications Command Center — $350
A self-directed 30-day implementation portal containing: step-by-step migration guides for Gmail, Google Chat & Spaces, Google Meet, Google Calendar, and Gemini AI · the Internal Champion Protocol · the 30-Day Migration Roadmap · access to the Smart Ops Command Center portal · and the Resource Library.

Additional Pillars (Pillar 2: Presence & Video, Pillar 3: Knowledge & Asset Governance, Pillar 4: Business Logic & Automation) are sold separately and governed by these same terms unless otherwise specified in writing.

Section 02
Access License

Upon purchase, Smart Ops Toolkit grants you a limited, non-transferable, non-exclusive license to access the Command Center portal for the organization registered at the time of purchase. This license is for internal organizational use only.

Permitted uses:

  • Access and use the portal content for your organization's internal Google Workspace migration
  • Share implementation protocols with internal staff and designated Internal Champions
  • Download and retain PDF resources provided as part of the bundle

Not permitted:

  • Reselling, sublicensing, or sharing portal access credentials with external parties
  • Reproducing or redistributing proprietary protocols, guides, or scripts for commercial purposes
  • Using the content to build or market a competing product or service
Section 03
Refund Policy

Smart Ops Toolkit products are digital goods delivered immediately upon purchase. Because access to the Command Center portal is granted at the time of purchase, all sales are considered final.

48-Hour Review Window: If you experience a technical issue that prevents access to the portal within 48 hours of purchase and the issue cannot be resolved by our support team, you may request a full refund. Refund requests must be submitted to info@smartopstoolkit.com within 48 hours of purchase with your Stripe receipt number.

Refunds will not be issued for: change of mind after access is granted, failure to use the product, organizational budget changes, or requests submitted after the 48-hour window.

Section 04
Tier 2 Guided Implementation — Escalation Terms

Tier 2 Guided Implementation is an optional add-on service available to Pillar 1 purchasers who require hands-on architect support during their migration. This is a separate, paid engagement governed by the following terms:

Tier 2 — Guided Implementation Session
90-Minute Architect Session
Screen-share guided session with a Smart Ops Architect. Covers your specific Workspace environment, registry configuration, and implementation blockers. Includes a session summary and 72-hour follow-up window for clarification questions.

Tier 2 sessions are scheduled at the time of booking and are subject to the following cancellation policy:

  • Cancellations made more than 24 hours before the scheduled session: full refund
  • Cancellations made within 24 hours of the scheduled session: no refund
  • No-shows without prior notice: no refund, session forfeited
  • Once a Tier 2 session has been conducted, no refund will be issued regardless of outcome

Tier 2 does not guarantee a specific outcome or complete migration. It provides expert guidance only. Results depend on your organization's Google Workspace environment, admin access, and internal team capacity.

Section 05
Google Workspace Dependency

Smart Ops Toolkit products are designed exclusively for organizations using Google Workspace for Nonprofits or Google Workspace for Business. The portal, guides, and protocols assume active Google Workspace admin access.

Smart Ops Toolkit is not affiliated with, endorsed by, or a partner of Google LLC. Google Workspace is a product of Google LLC and is subject to Google's own terms of service and availability. Smart Ops Toolkit is not responsible for changes Google makes to Workspace features, pricing, or availability.

It is the purchaser's responsibility to obtain and maintain a valid Google Workspace license. Smart Ops Toolkit does not provide or manage Google Workspace accounts.

Section 06
Intellectual Property

All protocols, guides, scripts, frameworks, portal content, and materials provided through Smart Ops Toolkit are the exclusive intellectual property of Bergman Holdings LLC. The "Smart Ops Toolkit" name, logo, and the Pillar framework are proprietary.

Your purchase grants you a use license as described in Section 02. It does not transfer ownership of any intellectual property to you or your organization.

Section 07
Limitation of Liability

To the maximum extent permitted by applicable law, Bergman Holdings LLC and Smart Ops Toolkit shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, any Smart Ops Toolkit product.

Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for that specific product.

Section 08
Updates to These Terms

Smart Ops Toolkit reserves the right to update these terms at any time. Material changes will be communicated via email to active purchasers at least 14 days before the change takes effect. Continued use of the portal after that date constitutes acceptance of the updated terms.

The current version of these Terms of Use is always accessible via the Smart Ops Command Center portal footer.
